Postconviction Integrity

Postconviction Case Review — Florida Rule 3.850

Not every case ends at sentencing. Our office provides objective record evaluations to determine if viable grounds for relief exist under Florida’s postconviction rules.

What is Rule 3.850?

Florida Rule of Criminal Procedure 3.850

Rule 3.850 permits certain individuals to seek postconviction relief after conviction and sentencing.

Depending on the case, claims may involve:

Ineffective assistance of counsel
Newly discovered evidence
Errors affecting trial fairness
Certain sentencing issues

"Not every case qualifies. Each matter must be carefully evaluated under established legal standards and procedural requirements."

Procedural Threshold

Strict Filing Deadlines Apply.

In many cases, a Rule 3.850 motion must be filed within two years after a conviction becomes final. Missing these windows can permanently compromise legal eligibility.

Timing Matters

Strict Filing Deadlines Apply

In many cases, a Rule 3.850 motion must be filed within two years after a conviction becomes final.

Missing deadlines or filing incomplete claims may permanently limit available options. For that reason, a careful review of the record is often necessary before determining whether a legally sufficient claim may exist.
